Crypto brief: October 28, 2026

Why today matters

The range is still the story, even with a greener tape. Bitcoin was $80,649, up about 0.63% on the 24-hour print, and ether was $2,343.42, up 0.79%, in a CoinGecko snapshot fetched at 2026-10-28T00:15:16+00:00. Solana printed $101.07 (+0.14%). Combined market cap sat near $2.72 trillion, with bitcoin share about 59.4% and 24-hour volume near $63.0 billion.

Filings and venues moved first. The CFTC sued Utah to keep state gambling law off CFTC-registered prediction markets. Empery Digital reported 1,018 bitcoin as of October 23. Teku shipped 26.10.3 after the eMudhra certificate-authority compromise. Spark asked for a $10 million Zyfai USDC pilot. Kraken will replace 176 native pairs with synthetic books from November 6. Ethresear mapped post-quantum peer-to-peer work, Magicians drafted a signing-verification ERC, and a Lido forum post asked the DAO to fund an external treasury audit.

  1. CFTC sues Utah to keep prediction markets under federal jurisdiction

The CFTC posted press 9315-26 on October 27 saying it sued Utah to block the state from shutting CFTC-registered contract markets with state law. The complaint, docket 2:26-cv-01055 in the District of Utah, names the State of Utah and Attorney General Derek Brown and follows Utah's October 20 state-court case against Kalshi and others. Chairman Michael S. Selig said Utah seeks to shut down prediction markets across a wide variety of markets, and the Commission said it has also started cases against nine other states and filed briefs in four federal appeals courts and one state supreme court. This is a jurisdiction fight, not a new event-contract rule.

  2. Empery Digital reports 1,018 bitcoin and resumes share buybacks

Empery Digital's October 26 Form 8-K (accession 0001683168-26-008071) said that as of October 23, 2026 the company held 1,018 bitcoin, about $70 million in cash, and about $35 million in debt. In the week ending October 23 it repurchased 122,955 shares at an average $2.89, including fees, under a $200 million program. Aggregate buybacks reached 26,363,499 shares, about $50 million remains on the authorization, and 29,694,955 shares were outstanding after 1,653,686 pre-funded warrants. Item 7.01 is an FD disclosure, not a new bitcoin purchase print.

  3. Teku 26.10.3 drops eMudhra roots after a Java CA compromise

Consensys posted Teku 26.10.3 on October 27 as a recommended update for CVE-2026-111943, the eMudhra compromised-keys incident. The release says Docker images no longer trust emSign ECC Root CA-G3, emSign Root CA-G1, emSign Root CA-G2, or AAA Certificate Services, matching OpenJDK's October 2026 guidance. Teku's linked advisory says a default mainnet node with no https:// URLs is not affected, and that Java does not check revocation by default. This is a TLS-trust patch, not a consensus-fork binary.

  4. Spark asks to pilot $10 million of SLL USDC through Zyfai

An October 27 Spark forum post asked Phoenix Labs, BA Labs, and Spark contributors for feedback on a Spark Liquidity Layer pilot with Zyfai, on Ethereum mainnet only, before any formal spell. Zyfai would run up to $10 million USDC, rebalanced daily across allowlisted USDC lending venues, with Spark keeping custody in a Safe owned by SPARK_PROXY and a 10 million rate limit on the existing transferAsset path. Over 90 days, net of a 5% Zyfai fee, the post said Spark's margin over the Sky Savings Rate would have been 96 bps on a conservative sleeve and 278 bps on an aggressive sleeve, versus 57 bps for Spark Blue Chip USDC. This is a pilot request, not a passed allocation.

  5. Kraken will replace 176 native pairs with synthetic books in November

Kraken's status page scheduled incident qrp07pm4w0bs says it will delist about 176 native trading pairs and replace them with synthetic pairs. Affected books move to cancel-only at 14:00 UTC on November 6, remaining open orders are canceled November 6-9, and replacement synthetic pairs list at end of day November 9. Open orders will not transfer. Kraken posted a Support Center list of the affected pairs. This is a book-structure change, not a chain halt.

  6. Ethresear maps post-quantum P2P work the consensus layer still lacks

Nyx Foundation's adust09 posted an inventory on October 27 arguing Ethereum consensus-layer networking has no adopted post-quantum migration profile. Replacing validator BLS with leanXMSS would not update ENR signatures, Discovery v5, libp2p Peer IDs, or QUIC/TLS, and the post flags a 300-byte ENR cap and a 1,280-byte Discovery packet cap. It maps three targets (discovery, connection key exchange, connection authentication) without picking an algorithm or activation date. This is research, not a fork schedule.

  7. Magicians draft STVA to make wallet signing independently verifiable

Ethereum Magicians thread 30106, posted October 27, drafts an ERC for Secure Transaction Verification and Authorization (STVA) after signing-flow and supply-chain attacks, including the February 2025 Bybit Safe incident the author cites at about $1.4 to $1.5 billion. The draft wants a Verification Payload, a semantic intent string, an independent simulator, and short-lived scoped capabilities built on EIP-712 and ERC-1271. It asks wallet teams whether to lean on ERC-7683 intents and how strict a multisig ceremony should be. This is an application-layer draft, not a protocol EIP.

  8. Lido forum asks the DAO to fund an independent treasury audit

An October 27 Lido research post says the Core Team and Finance Workgroup missed a 14-day ask, dated October 13, for an itemized 2024-2026 financial report on incubation costs and new products. The proposal would authorize up to $150,000, with a hard cap of $400,000 in USDC, USDT, or ETH equivalent, paid from the Aragon Agent treasury after Steakhouse Financial picks among Convoy Finance, Llama, or Fox Audit. Scope includes Lido Earn, stVaults, Wisp, and Lido Lend spend versus on-chain revenue. This is a forum proposal, not a completed Snapshot.
