France’s National Assembly adopted amendment I-3898 to the 2027 finance bill on Friday, 16 October 2026. The public ballot was 38 votes for and 37 against, with 100 voters and 75 expressed ballots. Absolute majority sat at 38. That is a first-reading floor win, not a tax that is live this weekend.
The text would change article 150 VH bis of the French tax code so a crypto-to-crypto exchange no longer gets automatic deferral when the asset received is a MiCA electronic money token, or a right tied to one. The amendment says that change would apply to sales and exchanges from 1 January 2027. Bitcoin (BTC) last printed $81,387 (−0.18% over 24 hours) on the desk CoinGecko snapshot fetched at 2026-10-17T23:56:33+00:00. Ether (ETH) was $2,398.98 (−0.90%). Solana (SOL) was $103.33 (−0.98%). Those prints do not make Friday’s vote a law.
Our stance is blunt. Traders who park gains in dollar tokens because French law still treats that hop as an exchange, not a cash-out, should plan as if that shelter is on a 2027 clock. Anyone trading Friday’s 38–37 as if the Journal officiel already printed it is early. Narrative is cheap. Exit liquidity that still looks tax-deferred is the thing that can vanish.
What happened
Amendment I-3898 sits on projet de loi de finances pour 2027, document n° 3210. Nicolas Sansu (Gauche démocrate et républicaine) filed it on Saturday, 10 October 2026, with GDR co-signers. The Assembly published the record on 14 October. Open-data JSON on the same page timestamps the sort as Adopté at 2026-10-16T15:42:50+02:00. Stage of reading: first reading, first house seized, in public sitting.
The second sitting of Friday 16 October 2026, under Christophe Blanchet, grouped I-3898 with amendments 3680 and 3738. GDR asked for a public ballot on 3898. The official compte rendu records 100 voters, 75 expressed, majority 38, 38 for, 37 against. The chair announced adoption. Amendments 3680, 1808, 1809, and 3670 fell as a consequence.
The operative sentence is narrow. It adds a paragraph to the A of II of 150 VH bis: the exchange deferral does not apply when the seller receives electronic money tokens within the meaning of point 7 of paragraph 1 of article 3 of Regulation (EU) 2023/1114 of 31 May 2023, or rights relating to them. That is the MiCA definition of an e-money token, not a slogan for every coin traders call a stablecoin. The rest of the amendment rewrites sale price, acquisition price, and weighted-average cost once that exception fires, and it offers two ways to reconstruct cost basis for tokens held before 1 January 2027.
Sansu’s explanatory note says the point is to close a deferral that, in his words, lets conversions into fiat-pegged stablecoins escape the prélèvement forfaitaire unique (PFU), France’s flat tax on this class of gains, while a conversion into euro or dollar cash does not. The note also claims the United Kingdom and Italy have already moved in that direction. That UK/Italy line is the authors’ claim in the filing, not a statute we verified here.
Context
French 150 VH bis is the crypto capital-gains article. In the current design, an exchange of crypto-assets for other crypto-assets can sit in a sursis d’imposition, a deferral, until a later taxable event. Cash into legal tender is the clean taxable moment. Dollar-pegged tokens blurred that line years ago. Traders use them as a parking lot: leave bitcoin, sit in a token that is supposed to hold a dollar, and wait.
MiCA, Regulation (EU) 2023/1114, splits the pegged world. Electronic money tokens purport to hold a stable value by referencing an official currency. Asset-referenced tokens are a different bucket. Algorithmic or crypto-collateralized dollars are not automatically EMTs because a trader treats them as cash. If I-3898 becomes law as written, the tax clock starts when the received asset is an EMT, not when a ticker is called “stable.”
DefiLlama’s stablecoin circulating table, retrieved 2026-10-18 near 00:15 UTC, showed about $307.0 billion across listed pegs. Tether (USDT) was about $183.4 billion. USD Coin (USDC) was about $72.6 billion. Whether each name is an authorised EMT in the Union is a separate legal fact. The table is the size of the parking lot, not a MiCA licence list.
The finance committee had already adopted the paired amendments, Philippe Juvin, the rapporteur général, told the sitting. He then said he still thinks deferral is relevant because crypto prices move a lot. David Amiel, minister for public action and accounts, thanked Sansu, pointed to EU DAC 8 wallet reporting, and said the amendment in substance treats stablecoins as money. He also said the debate was not ripe and that tracing reallocations inside a wallet is hard. The floor voted anyway.
Bitcoin’s cycle is the other half of the trap. Our Bitcoin history page is the long tape of draws that make a parking-lot token look like a free option. If the hop into an EMT becomes a PFU event in 2027, that option is no longer free for a French taxpayer. The stablecoin glossary is the plain definition: a token that tries to hold a peg, not a euro in a bank.
Our read
I do not read I-3898 as a live French tax on USDT this Sunday. I do read it as a first-reading instruction that the Assembly is willing, on a thin Friday ballot, to treat a hop into a MiCA e-money token as the cash-out. That is market structure, not a press release.
Who is trapped if the article survives the Senate and the final statute? French residents who size risk in bitcoin or ether, then roll into Tether or USDC-style EMTs as if that roll were still a non-event. Venue desks that sell “stable” as the tax-free sideline. Issuers in the EMT bucket. Who is not trapped yet? Anyone whose parking token is not an EMT under article 3(1)(7). Anyone outside 150 VH bis. Anyone waiting for the Senate. The vote does not collect tax in October 2026.
The minister is right that definitions and traceability are the guts. He is wrong if the subtext is that a 38–37 adoption can sit in a drawer until a perfect definition arrives. The Assembly already wrote the filter: MiCA EMT, from 1 January 2027, with a one-time basis choice for pre-2027 lots. Finance bills still have a Senate and a Journal officiel.
We already treated a U.S. stablecoin rulemaking as a proposal, not a licence, in the desk’s GENIUS NPRM reaction. The FSB note was monitoring, not a G20 statute, in that FSB piece. Same habit here. First reading is first reading.
Falsifiable claim: By 2026-12-31 23:59 UTC, if the French Journal officiel has published the 2027 finance law and article 150 VH bis as enacted still applies the current exchange deferral to receipts of MiCA electronic money tokens (the I-3898 carve-out is absent), then treating Friday’s 38–37 adoption as a locked 1 January 2027 tax clock is wrong. If the Journal officiel has published that carve-out in the enacted law, then treating the vote as theatre that traders can ignore is wrong.
What to watch next
First, the rest of the first part of PLF 2027 and the text the Assembly actually transmits. A Friday amendment can still be rewritten or dropped before the house votes the whole revenue block. Watch whether I-3898’s article remains in the adopted first-reading text, not only on the amendment card that currently says Adopté.
Second, the Senate. This is a finance bill. If senators restore full 150 VH bis deferral for EMT receipts, Friday’s ballot becomes a footnote. If they keep the carve-out, the 1 January 2027 date in II.A of the amendment is the date that matters.
Third, the EMT line itself. The tax does not say “every stablecoin.” It says electronic money tokens under MiCA article 3(1)(7). That is the filter for mapping USDT, USDC, euro EMTs, and tokens that are only collateralized dollars. A later BOFiP note that stretches or shrinks that filter would move the trapped set more than another TV debate.
Fourth, companion ideas in the same sitting: a later declaration duty on digital-asset holdings (Sansu pointed to Charles de Courson’s amendment 2701 after article 32) and the minister’s DAC 8 timeline. Those are not I-3898.
If you still use social feeds as a primary tape, read how to follow crypto news without getting played. Friday’s story is an amendment page, a JSON sort stamp, and a scrutin line. The minister cited 31.4% PFU in the same sitting on a different capital-income fight. I-3898’s note points at PFU without printing a new rate in the dispositif.
Plan the 2027 clock. Do not pay a tax that does not exist yet. Do not pretend a 38–37 first-reading adoption is nothing.
